Pakka AI Technologies ("Pakka AI", "we", "our", or "us") operates a WhatsApp-native escrow and contract platform for freelancers and clients in India. This Privacy Policy explains how we collect, use, store, and protect your information when you use our services through WhatsApp or pakkaai.com.

1. Information We Collect

We collect the following information when you interact with Pakka AI:

WhatsApp phone number - used as your primary identity on the platform
Name - provided by you during deal creation or registration
Email address - optional, used for contract and payment notifications
Deal information - scope of work, agreed amount, deadline, milestone details
Payment information - UPI handle or payment method (we do not store card numbers)
Message content - WhatsApp messages sent to our bot, used to understand your deal requirements and respond appropriately
Device and usage data - IP address, browser type, pages visited on pakkaai.com

2. How We Use Your Information

To create and manage escrow-backed contracts between clients and freelancers
To process and track payments via Razorpay
To send deal confirmations, payment receipts, and dispute notifications via WhatsApp and email
To generate legally binding PDF contracts under Indian law
To enforce the Ghost Registry - detecting and blocking users with confirmed fraud or non-payment incidents
To improve our platform and fix bugs
To comply with legal obligations under Indian law

3. WhatsApp and Meta

Pakka AI uses the WhatsApp Business Platform (Meta). When you message our WhatsApp number, your messages are processed through Meta's infrastructure. We use the WhatsApp Cloud API solely to receive your deal requests and send you deal-related notifications. We do not use your WhatsApp data for advertising. Meta's own privacy policy governs their handling of your data on their platform.

4. Payments and Escrow

Payments are processed through Razorpay. Pakka AI does not store your full card details or bank account numbers. Payment data is handled by Razorpay in accordance with PCI-DSS standards. Your UPI handle is stored to enable payouts and is encrypted at rest.

5. Data Sharing

We do not sell your personal data. We share data only in these circumstances:

With the other party in your deal - your name and masked phone number are visible to your deal counterpart
With Razorpay - for payment processing and payouts
With legal authorities - if required by court order or applicable Indian law
With Afham Kavil (our legal counsel) - for dispute resolution and legal notice review on deals above ₹5,00,000

6. Data Retention

We retain your deal data and transaction records for 7 years as required by Indian financial regulations. Conversation history is retained for 12 months. You may request deletion of your account data by contacting us, subject to legal retention obligations.

7. Security

All data is encrypted in transit (TLS 1.2+) and at rest (AES-256). Our escrow ledger is append-only - no transaction can be altered or deleted. Contract documents are SHA-256 hashed for evidentiary integrity. We conduct regular security reviews.

8. Your Rights

Under the Information Technology Act, 2000 and applicable Indian data protection laws, you have the right to:

Access the personal data we hold about you
Correct inaccurate data
Request deletion of your data (subject to legal retention requirements)
Withdraw consent for optional data uses

9. Cookies

pakkaai.com uses minimal cookies for session management and analytics. We do not use advertising cookies or track you across third-party sites.

10. Children's Privacy

Pakka AI is not intended for users under 18 years of age. We do not knowingly collect data from minors.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by posting the updated policy at pakkaai.com/privacy.html and updating the "Last updated" date above. Continued use of Pakka AI after changes constitutes acceptance of the revised policy.
