Terms of Service

Welcome to Pakka AI. By using our WhatsApp bot or website at pakkaai.com, you agree to these Terms of Service. Please read them carefully.

1. About Pakka AI

Pakka AI Technologies ("Pakka AI", "we", "us") operates a WhatsApp-native escrow and contract platform that helps clients and freelancers in India create legally binding agreements, hold payments in escrow, and resolve disputes.

2. Eligibility

• You must be at least 18 years old to use Pakka AI
• You must be located in India or conducting transactions governed by Indian law
• You must have a valid WhatsApp account and Indian mobile number
• By using the service, you confirm you have the legal capacity to enter contracts

3. How the Service Works

Pakka AI facilitates deal creation, contract generation, and payment escrow between two parties. We are a facilitator - not a party to your deal. The contract is between the client and freelancer; Pakka AI provides the infrastructure.

• Deals are created via WhatsApp conversation
• Payments are held in escrow via Razorpay
• Contracts are generated automatically and are legally binding
• Disputes are mediated by Pakka AI within 7 business days

4. Platform Fee

Pakka AI charges a platform protection fee of 2.5% of the deal amount. The fee is paid by the Client, added on top of the amount quoted by the Service Provider. The Service Provider receives the full quoted amount on milestone approval; the platform fee is retained by Pakka AI from the funds collected from the Client. Payment-gateway charges (Razorpay or successor) are absorbed within the 2.5% - no separate gateway fee is deducted from either party. Early users (first 1,000 registered) receive a 1.5% lifetime fee rate on the same client-paid basis.

5. Escrow & Payments

• Client funds are held in escrow and released only upon approval of deliverables
• If no action is taken within 48 hours of delivery, funds are automatically released (implied acceptance)
• Payments are processed via Razorpay and subject to their terms
• Pakka AI is not a bank or payment service provider

6. Prohibited Uses

You may not use Pakka AI for:

• Illegal goods or services
• Adult or explicit content
• Fraudulent deals or identity misrepresentation
• Money laundering or financing of illegal activities
• Harassment of other users or the Pakka AI team
• Automated bots or scrapers

7. Ghost Registry & Bans

Users with 2 or more confirmed breach incidents (non-payment, ghosting, fraud) will be permanently banned from creating new deals. Ban decisions are made by Pakka AI at our sole discretion. Appeals can be sent to hi@pakkaai.com.

8. Dispute Resolution

Pakka AI provides mediation as a courtesy. Our decision is non-binding advisory. For legally binding resolution, parties may pursue:

• Lok Adalat (for disputes up to ₹20 lakhs)
• Arbitration under the Arbitration and Conciliation Act, 1996
• Civil courts with jurisdiction in Kerala, India

9. Limitation of Liability

Pakka AI is not liable for: losses arising from user disputes, payment failures outside our control, errors in AI-generated contracts, or actions of third-party services (Razorpay, Meta/WhatsApp).

Our total liability to any user shall not exceed the platform fees collected from that user in the preceding 3 months.

10. Intellectual Property

All IP in the Pakka AI platform (code, design, AI models, templates) belongs to Pakka AI Technologies. Contracts generated for your deals belong to you.

11. Changes to Terms

We may update these terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified via WhatsApp.

12. Governing Law

These terms are governed by the laws of India. Disputes are subject to the jurisdiction of courts in Kerala, India.
